Welcome to VoteCast, a proprietary CRM and data platform owned and operated by Practical Political Data DBA VoteCastHQ. By accessing our services or using our platform, you agree to be bound by the following Terms of Service.

 

1. Services Provided

Practical Political Data DBA VoteCastHQ provides political data consulting, voter file management, and access to the VoteCast CRM platform. These services are intended for use by political campaigns, non-profit organizations, and other authorized entities.

2. Account Responsibilities

​

  • Authorized Access: You are responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account is your responsibility.

  • National Use: As VoteCastHQ expands to all 50 states, users agree to comply with the specific election laws and data privacy regulations of the jurisdiction in which they are operating.

3. Data Usage & Compliance

  • Voter Data Restrictions: Users agree that voter data provided through the platform (including data integrated from partners like L2) shall be used exclusively for political, governmental, or non-commercial purposes as defined by applicable state laws.

  • Prohibited Acts: Users may not sell, trade, or distribute voter data obtained through VoteCastHQ to unauthorized third parties.

  • Legal Compliance: You agree to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and all other relevant state and federal regulations regarding voter contact.

4. Intellectual Property

The VoteCast platform, including its dashboard analytics, proprietary algorithms, voter data, and software architecture, is the intellectual property of Practical Political Data DBA VoteCastHQ. Users are granted a limited, non-transferable license to use the software for the duration of their contract.  At not point whatsoever is ownership of the above ever transferred to client or their agents.

5. Third-Party Integrations

Our services include integrations with third-party providers (e.g., L2). Your use of such data is subject to both these Terms and the end-user license agreements of our data partners. Practical Political Data DBA VoteCastHQ is not responsible for the accuracy or availability of third-party data.

6. Limitation of Liability

​

Practical Political Data DBA VoteCastHQ shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or any campaign outcomes. We provide our data and platform "as is" without warranties of any kind, express or implied.

7. Termination of Service

​

We reserve the right to suspend or terminate access to the platform if a user is found to be in violation of these terms, or if the user's conduct is deemed detrimental to the integrity of the data or the platform.

8. Governing Law

​

These terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions.

10. Relationship to Other Agreements

​

These Terms of Service are intended to govern general platform use and digital access. Please note that any matters or terms not explicitly outlined in this document are subject to the provisions contained within your specific Data License Agreement and Service Contract. In the event of a direct conflict between these Terms and your signed Service Contract, the terms of the signed Service Contract shall take precedence.
